Nsfas a government agency which is governed by law(legal policies) has putten in place terms and conditions between them and the users of the scheme. Terms and conditions can be defined as the legal agreement between Nsfas and students. Every student who agrees to apply for the Nsfas bursary support must be willing to abide by the rules and conditions of the scheme.
Failure To go by the conditions of Nsfas will automatically terminate the agreement between you and Nsfas.

below are the terms and conditions that bind Nsfas and students:
1. T’S & C’S INTRODUCTION
1.1Welcome to NSFAS. We are excited that we have the opportunity to support you in your effortto successfully accomplish your academic goals.
1.2TheNSFASBursaryAgreement Terms and Conditions is anannexure to theNSFASBursary Agreementand forms part ofthe NSFAS Bursary Agreement.
1.3Please ensure that you are familiar with, and fully understand,theNSFAS Bursary Agreement, including the Terms and Conditions.

2.WHO ISELIGIBLE?
2.1TheDHETBursary Schemeisavailable to South African citizens who meet prescribed eligibility criteria.
2.2The various eligibility criteria are set out below.
2.3Academic Eligibility
2.3.1Students who have received confirmation of admission into a publichigher education institutionfor an approved funded qualificationand who meet theNSFAScriteria for financial assistance shall be eligible for NSFASadministered funding.
2.3.2Continuingstudents mustbe registered for the relevant academic year and mustsatisfy the minimum progression requirements of thehigher education institution andprogressionrules interms of the DHET National Rules and Guidelines.
2.4Financial Eligibility
2.4.1TheDHETBursary Scheme will be available to:
2.4.1.1studentswho registered at thehigher education institutionfor the first time in 2018or thereafter and who are from families with a combinedannual household incomeof up to R350 000 (three hundred and fifty thousand Rand);
2.4.1.2students with disabilities who registered at a higher education institution for the first time in 2018 or thereafter and who are from families with a combined annual household income of up to R600 000 (Six Hundred Thousand Rand)
2.4.1.3students with disabilities who registered at the higher education institution for the first time prior to 2018 and who are from families with a combined annual household income of up to R400 000 (Four Hundred Thousand Rand)
2.4.1.4studentswho registered at thehigher education institutionfor the first timepriorto2018and who arefrom families with acombined annual household incomeof up to R122 000 (one hundred and twenty–two thousand Rand); and
2.4.1.5studentswho arerecipients of grants administered throughtheSouthAfricanSocialSecurity Agency (“SASSA”)will automatically qualify for NSFAS funding.
2.4.2NSFAShas verifiedthe household income declared by the studentandassessedthatthe financial eligibilityofthestudent’s household income is within the parameters set out in2.4.1above.
3.1Successful NSFASapplicants shall be eligible for NSFAS student financial aid in the form of a bursary.
3.2The Bursary Amountper annumwillbe an amount equal totheactual cost oftuitionfor thequalification,and other related costs as prescribed in the DHETNational Bursary Rules and Guidelinesless any otherbursaries or fundingsupportreceived from other funders.
3.3Thestudy costs charged bythehigher education institutionshallbe paid as a credit to thestudent’s accountat thehigher education institution.
3.4All payments to thehigher education institutionshall be made in accordance with theintervals agreed between NSFAS and thehigher education institution.
3.5Any part of the Bursary Amount which has not been utilized by thehigher educationinstitutionto defray the costs of tuition and related costs(as prescribed by the DHET National Rules and Guidelines)shall be returned by thehigher education institutionto NSFAS, and the Bursary Amount will be reduced accordingly.
3.6NSFAS will be entitled if it so chooses after this Agreement has been signed but before any part of the Bursary, Amount has been paid to thehigher education institution, to amend the Bursary Amount.
3.7NSFAS will not be obliged to notify thestudent of any amendments made in terms of clause3.6above, other than by recording the outstanding balance of the bursary amount. That amended amount will constitute the Bursary Amount for the purposes of this Agreement.
4.1The allocation of allowances shall be determinedin accordance with the prevailingDHET NationalRules and Guidelinesas published from time to time.
4.2Thestudentshall only receive those allowances which have been allocated tohim/her in accordance with clauses 4.1.
4.3Thestudentcan access allowancesin one of two ways:
4.3.1as a direct deposit paid by NSFAS, or its duly appointed agent, directly into thestudent’s bank account; or
4.3.2in the form of an NSFAS Walletvoucherwhich is redeemable at participating NSFAS–Walletvendors.
4.4The following clauses relate to the allowances deposited directly into thestudent’s bank account:
4.4.1thestudent shall be responsible for providing the correct banking details to NSFAS during theapplication process;
4.4.2thestudent shall be responsible for protecting his/her bankaccount details, including the bank account PIN and shall not share his/her bank account details with any person;and
4.4.3thestudent shall immediately notifytheirbankof any breach of banking details.
4.5The following clauses relate to allowances accessedby way of the NSFAS–Wallet platform:
4.5.1the student shall be responsible for providing the correct mobile number details to NSFAS during the application process;
4.5.2the student shall be responsible for protecting his/her NSFAS Wallet account details,including the account/ voucher PIN and shall not share his/her account details with any person;
4.5.3the student shall immediately notify theNSFASof any breach ofNSFAS Walletdetails;
4.5.4by signing the Bursary Agreement,thestudent shall be deemed to haveagreed to theNSFAS–Wallet Terms and Conditionswhich NSFAS may amend from time to time;
4.5.5subject to such terms and conditions as NSFAS deems appropriate, thestudent’sNSFAS–Wallet account will be creditedwith an amount equal to the allowance allocation provided for in clause 4.2 above;
4.5.6any part of any allowanceredeemed bythestudentat anNSFAS–Walletvendorwillreduce the amount of that allowance by the amount so redeemed;
